1. Introduction

Welcome to Zoology with Will (the “Site”), including our online shop at https://shop.zoologywithwill.com and any associated sub-domains (collectively, the “Store”). The Store is operated by Zoology with Will (“Zoology with Will”, “we”, “us”, or “our”).

These Terms & Conditions (the “Terms”) form a legally binding agreement between you and us and govern your access to and use of the Store and any content, features, products or services made available through it (collectively, the “Services”).

By accessing or using the Services, or by placing an order, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy and (where applicable) our Cookie Notice, which are incorporated by reference. If you do not agree, you must not access or use the Services.

2. Changes to the Terms

We may revise these Terms from time to time to reflect changes in the law, our Services, or for operational reasons. Updated Terms will be posted on this page with a new “Last updated” date. Changes take effect immediately upon posting and apply to all subsequent access or use.

Where reasonably practicable, we will endeavour to provide notice of material changes (for example via a banner on the Store or by email). Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.

3. Eligibility

The Services are intended for individuals aged 13 years or older. If you are under 18, you may use the Services only with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

By using the Services, you represent and warrant that you:

  1. are at least 13 years old; and

  2. have the legal capacity to enter into these Terms (or have obtained parental/guardian consent).

4. Accounts

Certain features may require you to create an account. You agree to provide accurate, current and complete information, keep it up to date, and maintain the confidentiality of your login credentials. You are responsible for all activities that occur under your account.

We reserve the right to suspend or terminate accounts where we reasonably believe there has been a breach of these Terms, unlawful activity, or misuse of the Services.

5. Orders and contract formation

5.1 Placing an order. When you place an order, you are making an offer to buy products from us. Orders are subject to acceptance and availability.

5.2 Order acceptance. A contract between you and us is formed when we accept your order (typically when we send you an order confirmation and/or dispatch confirmation). We reserve the right to refuse or cancel any order, including where:

  • the product is out of stock or discontinued;

  • we suspect fraud, unauthorised or illegal activity;

  • there is a pricing or product description error; or

  • we cannot deliver to the address provided.

5.3 Order limits. We may apply limits to quantities purchased per order, per account, or per household where reasonably necessary (e.g., to prevent resale or abuse).

6. Prices, taxes and payment

6.1 Prices. Prices are shown on the Store in the currency indicated at checkout. Prices may change at any time, but changes will not affect orders already accepted.

6.2 Taxes. Where applicable, taxes (such as VAT) will be calculated and displayed at checkout. If you are ordering from outside the UK, you may be responsible for import duties, customs fees, and local taxes. These are not controlled by us and are generally non-refundable.

6.3 Payment. Payment must be made in full at checkout using the payment methods made available on the Store. Payment processing is handled by Shopify and/or its authorised payment providers. We do not store full payment card details on our own servers.

7. Shipping and delivery

7.1 Delivery times. Any delivery dates or timeframes shown are estimates only (unless we explicitly state otherwise). Delivery can be affected by factors outside our control.

7.2 Shipping charges. Shipping costs (if applicable) are shown at checkout.

7.3 Delivery address. You are responsible for ensuring the delivery address is accurate and complete. If an order is returned to us due to an incorrect address or failed delivery attempts, we may need to charge additional shipping to resend it.

7.4 Risk of loss. Risk of loss or damage passes to you on delivery to the address provided (or on collection, if applicable). If an item arrives damaged, please contact us promptly (see Section 10.4).

8. Returns, refunds and cancellations

8.1 Returns policy. Our approach to returns and refunds is set out in our Refund/Returns Policy, which is incorporated by reference into these Terms.

8.2 Statutory rights. Nothing in these Terms limits or excludes your statutory rights under applicable consumer protection laws (including, where applicable, UK consumer law).

8.3 Non-returnable items. Some items may be non-returnable for hygiene, customisation, or other reasons (where permitted by law). Any such exclusions will be stated in the Refund/Returns Policy and/or on the product page.

9. Promotions, discount codes and gift cards

9.1 Discount codes. Discount codes are subject to the terms presented with the promotion and may be time-limited, single-use, non-transferable, and/or excluded from certain products.

9.2 Gift cards. Gift cards (if offered) are subject to any terms shown at purchase and applicable law. Gift cards are generally non-refundable except where required by law.

10. Product information

10.1 Product descriptions. We strive to ensure product descriptions, images, specifications, and pricing are accurate. However, we do not warrant that all content is error-free, complete, or current.

10.2 Colours and appearance. Product colours and appearance may vary depending on your device display settings. Where products are printed or manufactured in batches, minor variations may occur.

10.3 Sizing. If you sell apparel, sizing guidance may be provided on product pages. You are responsible for selecting the appropriate size. If you are unsure, contact us before ordering.

10.4 Problems with your order. If your order is incorrect, incomplete, or arrives damaged, please contact us at hello@zoologywithwill.com with your order number and, where relevant, photos of the issue so we can investigate and assist.

11. Intellectual property

All content on the Services—including text, graphics, logos, icons, product photography, videos, podcasts, designs, source code, database rights, and the overall “look and feel”—is owned by or licensed to Zoology with Will and is protected by UK and international intellectual property laws.

Subject to your compliance with these Terms, we grant you a personal, revocable, non-exclusive, non-transferable, non-sublicensable limited licence to access and use the Services solely for your personal, non-commercial purposes. Except as expressly permitted, you may not copy, reproduce, modify, distribute, transmit, display, perform, publish, licence, create derivative works from, sell, or otherwise exploit any content without our prior written consent.

12. Permitted use and restrictions

You agree not to:

  • use the Services for any unlawful purpose or in violation of any applicable law or regulation;

  • infringe, misappropriate or violate our or any third-party intellectual property rights;

  • upload or transmit viruses, malware or other harmful code;

  • engage in data mining, scraping, harvesting or automated data-gathering (except as expressly permitted by robots.txt);

  • interfere with, disrupt, or negatively affect the servers, networks, or other infrastructure connected to the Services;

  • use the Services to promote or engage in advertising, marketing, or solicitation without our prior written consent;

  • impersonate any person or entity or misrepresent your affiliation with a person or entity; or

  • bypass or attempt to bypass measures we may use to prevent or restrict access to the Services.

13. User-generated content

The Services may allow you to submit, post or display content such as comments, reviews, photos, videos, audio, or other materials (“User Content”).

You retain ownership rights in your User Content, but by providing it you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable, perpetual and irrevocable licence to host, store, use, reproduce, publish, modify, create derivative works from, distribute and display such User Content in connection with the Services and our business (including across social media channels and for promotional purposes).

You are solely responsible for your User Content and represent that:
(a) you own or have all necessary rights to upload or share it; and
(b) it does not violate any third-party rights or these Terms.

We have no obligation to monitor User Content, but we reserve the right to edit, remove or disable access to any User Content at any time and for any reason.

14. Third-party links and services

The Services may contain links to third-party websites, content or services that are not owned or controlled by us (“Third-Party Services”). We provide these links for convenience only and do not endorse or assume any responsibility for Third-Party Services. Your use of Third-Party Services is at your own risk and subject to the terms and policies of the third party.

15. Educational content disclaimer

Any information provided through the Services (including any blog, video, or educational materials we may reference) is educational and informational in nature and offered as general interest material. It is not intended as professional veterinary, medical, legal, financial or other advice.

Although we strive for accuracy, we make no guarantees regarding the completeness, reliability or timeliness of any information. You should consult a qualified professional before relying on any information obtained through the Services.

16. No warranties

To the maximum extent permitted by applicable law, the Services and products are provided “as is” and “as available” without warranty of any kind, whether express, implied or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

We do not warrant that the Services will be uninterrupted, secure, or free from errors, defects, viruses or other harmful components. Your use of the Services is at your sole risk.

17. Limitation of liability

17.1 Nothing excluded. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for:

  • death or personal injury caused by negligence;

  • fraud or fraudulent misrepresentation; or

  • any other liability that cannot be limited by law.

17.2 General limitation. Subject to Section 17.1, and to the maximum extent permitted by law, Zoology with Will, its directors, employees, contractors, suppliers and agents will not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, or for loss of profits, revenues, goodwill, data or other intangible losses arising from or relating to your access to or use of (or inability to access or use) the Services.

17.3 Cap on liability. Subject to Section 17.1, our total liability to you for any claim arising out of or relating to the Services or a purchase will not exceed the total amount paid by you for the applicable order giving rise to the claim.

18. Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend and hold harmless Zoology with Will and its officers, directors, employees and agents from and against claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or in any way connected with:
(a) your access to or use of the Services;
(b) your User Content; or
(c) your violation of these Terms or any applicable law.

19. Termination

We may suspend or terminate your access to all or part of the Services at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law.

Upon termination, all licences and rights granted to you under these Terms immediately cease, but provisions that by their nature should survive will survive, including Sections 11, 13, 15–18, 20, and 22.

20. Governing law and jurisdiction

These Terms and any dispute arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of England and Wales, excluding its conflict-of-law rules.

The parties submit to the exclusive jurisdiction of the courts of England and Wales, except that we may seek injunctive or equitable relief in any jurisdiction to protect our intellectual property rights.

21. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.

22. Entire agreement

These Terms constitute the entire agreement between you and Zoology with Will regarding the Services and supersede all prior or contemporaneous oral or written communications on the subject matter.

In the event of any conflict between these Terms and any other policy or guideline posted on the Store, these Terms shall prevail, unless expressly stated otherwise.
